Water, Human Rights and Legislation process
Air adalah bagian yang tidak terpisahkan dari hak asasi manusia. Hal ini
muncul secara implisit dalam Kovenan Internasional Hak Ekonomi, Sosial dan
Budaya (International Covenant on Economic, Social and Cultural Rights),
terutama pasal 11 tentang hak atau standar kehidupan yang layak disatu sisi
dan kewajiban negara disisi yang lain, serta pasal 12 tentang hak atas
kesehatan rohani dan jasmani, yang terkait didalamnya hak atas air. Hak atas
air disebutkan secara eksplisit dalam General Comment No. 15 terhadap
Kovenan tersebut yang diterima oleh The United Nations on Economic, Social
and Cultural Rights that is entitled "the rights to water".
Hak atas air ini juga ditegaskan dalam Decision 1999/108 yang diadopsi oleh
The United Nations Commission on Human Rights yang menyatakan bahwa
"hak atas air minum dan pelayanan sanitasi adalah hak asasi manusia".
Penegasan tersebut juga dilakukan melalui Resolusi Sub Commission on
Prevention of Discrimination and Protection of Minorities 1998/7 yang
menyatakan bahwa "hak atas air minum dan sanitasi bagi laki-laki, perempuan
dan anak-anak adalah prinsip fundamental dari persamaan, martabat manusia
dan keadilan sosial".
Segala ketentuan dan pengakuan internasional tersebut menyebabkan hak
atas air dimasukkan sebagai bagian dari instrumen kebiasaan internasional
(international customary law), sehingga keberadaannya mengikat bagi semua
negara di dunia, termasuk Indonesia.
Sebagai bagian dari hak asasi manusia, hak atas air dimasukkan sebagai
bagian dari "guaranteed constitutional rights" atau hak yang dijamin oleh
konstitusi, bukan kategori "regulated rights" yang pemenuhannya tergantung
pada kehendak baik para pelaku dan pemegang otoritas politik formal.
Keberadaannya tidak boleh dikurangi, baik seluruhnya atau sebagian, termasuk
oleh Undang-Undang sekalipun.
Dalam konsep hak asasi manusia, rakyat berposisi sebagai pemegang hak
(rights holder) dan berada dalam posisi yang sebaliknya, negara berposisi
sebagai pengembang kewajiban (duty holder). Dalam konteks ini, negara
mempunyai kewajiban (state obligation) untuk menghormati (to respect),
memajukan (to promote), menjamin (to guarantee), mengakui (recognize),
memenuhi (to fulfill) serta melindungi (to protect) hak asasi setiap manusia,
utamanya warga negaranya. Atas mandat-mandat tersebut, negara dituntut
untuk mengambil langkah-langkah yang efektif guna memastikan bahwa tidak
ada hak-hak serta kebebasan asasi warga negara yang terkurangi.
Sedikit dari persoalan air adalah buruknya kualitas air dan terjaminnya akses
atas air.

back in 20th century many artist spoke up their mind about the environmental change with their own way, and they created a marvelous state of art, pointing the messages to be delivered to the audiences. Audiences entertained and also received the messages with joyful.
here is one of the greatest jazz artist which contribute his will through the song, collaborated with great Motown Musician, not to mention the well known John Lennon's Imagine or Joni Mitchell's Big Yellow Taxy (re-recorded by Vannesa Carlton and Counting Crow).
